Terms of Service — TwoNest

These Terms of Service ("Terms") govern your use of the TwoNest mobile application ("the App"), whether you downloaded it from Google Play, where it is published by Dream Studio, or from the Apple App Store, where it is published by Ky Le Quang. "We" and "us" mean the publisher of the version you downloaded. By downloading or using the App you agree to these Terms and to our Privacy Policy.

1. The Service

TwoNest is a private space for two people in a relationship: a love-day counter, moods, notes, nudges and heartbeat cards, daily questions, quizzes and the Journey, time-capsule letters, 24-hour moments and photo memories, a shared calendar and to-dos, shared money tracking and big-day planning. You can use the day counter on your own without an account. Connecting ("pairing") with a partner, and every shared feature, requires signing in with Google, Facebook, Apple (on iOS), or an email address and password.

2. Accounts and Pairing

• You must provide accurate information and are responsible for activity under your account.
• One account can be paired with one partner at a time. Invite codes expire after 48 hours and can be used once.
• Content created inside a paired space is shared by both members of the couple: either of you can view, edit and delete any of it.
• If either of you unpairs, the shared space is hidden from both of you immediately and permanently deleted 30 days later.
• If either of you deletes their account, the shared space, including all photos, is permanently deleted right away, for both of you.
• Neither action can be undone, and a new pairing always starts with an empty space. If you want to keep your photos, download them first (Us tab → "Download all our photos") while you are still paired.
• You must be at least 13 years old, or the minimum digital-consent age in your country, to use the App.

3. Your Content

You keep ownership of the content you create, such as photos, letters, notes and answers. You give us a limited license to store, process and transmit that content only to operate the service, for example syncing it to your partner's device and sending notifications. We do not use your private content for advertising.

You agree not to upload content that is unlawful, infringes others' rights or contains malware. We may remove content or suspend accounts that violate these Terms.

4. Couple Premium and Ads

• The free version is supported by advertising and has limits on some features, for example photos per memory, moments per day, Journey chapters or guests per big-day event.
• Couple Premium is an auto-renewing subscription, billed monthly or yearly. You buy it through the store you downloaded the App from: Google Play on Android or the App Store on iOS.
• One subscription covers both members of a paired couple, including removing ads for both, while the purchaser's subscription is active.
• Prices are shown in the App before you buy. Payment is charged to your Google Play account or Apple Account when you confirm the purchase.
• The subscription renews automatically at the same price and period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• Manage or cancel at any time: on Android in Google Play → Subscriptions; on iOS in Settings → your name → Subscriptions. Cancelling stops the next renewal; you keep Premium until the end of the period you paid for.
• Restoring purchases: use "Restore purchase" in the App to recover a subscription on a new device signed in to the same Google or Apple account.
• Refunds are handled by the store under its own policy: Google Play's refund policy on Android, Apple's on iOS. We cannot issue refunds for store purchases ourselves.
• Partner benefits: the partner's shared benefits are confirmed each time the purchaser opens the App, and each confirmation lasts up to 15 days. If the purchaser does not open the App for longer than that, the partner's benefits pause until they do. If the purchaser unpairs, the partner's benefits end immediately.
• When Premium ends, content you already created beyond the free limits is kept; only adding more beyond those limits is blocked.
• Unpairing or deleting your account does not cancel a subscription. Cancel it in your store settings as described above.

5. Acceptable Use

You agree not to:

• use the App for any unlawful purpose;
• attempt to access another person's couple space or data;
• interfere with, probe or disrupt the service or its security measures;
• reverse engineer the App except where permitted by law;
• resell or commercially exploit the service.

6. Termination

You may stop using the App and delete your account at any time (Us tab → Delete account). Deleting your account also permanently deletes the space you share with your partner, as described in Section 2. We may suspend or terminate access that violates these Terms or harms the service, its users or third parties.

7. Disclaimers

The App is provided "as is" without warranties of any kind, to the extent permitted by law. We do not guarantee uninterrupted or error-free operation, or that notifications and letters will always be delivered at the exact time (your device or operating system may restrict background delivery). The App is a personal organization tool; nothing in it is financial, legal or relationship advice.

8. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for loss of data caused by factors outside our reasonable control. Our total liability for any claim related to the App is limited to the amount you paid for the App in the 12 months before the claim.

9. Additional Terms for the Apple App Store Version

If you downloaded TwoNest from the Apple App Store, the following also applies:

• For the App Store version, these Terms are between you and Ky Le Quang only, not Apple. Ky Le Quang, not Apple, is solely responsible for the App and its content.
• Your license to use the App is limited to Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide any maintenance or support services for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Ky Le Quang, not Apple, is responsible for addressing any claims relating to the App or your use of it, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
• If a third party claims that the App or your use of it infringes their intellectual property rights, Ky Le Quang, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms when using the App, such as the terms of your mobile carrier or data service.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right, and is deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary.

10. Google Play Version

If you downloaded TwoNest from Google Play, your use of Google Play, including purchases, is also subject to the Google Play Terms of Service. Google is not responsible for the App or its content.

11. Changes to the Service or Terms

We may modify the App or these Terms. Material changes to the Terms will be announced in the App; continued use after changes take effect means you accept them.

12. Governing Law

These Terms are governed by the laws of Vietnam, without regard to conflict-of-law rules. Disputes will be resolved in the competent courts of Vietnam, unless mandatory consumer law in your country provides otherwise.
